Terms and conditions
Welcome to Latin Link, a technology platform designed to facilitate interaction with decentralized blockchain networks such as Flare and others we may integrate in the future (the "Compatible Blockchains"). By using our application or website (the "Platform"), you agree to these Terms and Conditions ("Terms"). If you do not agree, please do not use the Platform. We recommend that you read these Terms carefully.
1. Nature of the platform
Latin Link is a technological tool that enables users to interact with Compatible Blockchains to carry out actions such as delegation, participation in rewards (e.g., Flare Drops), or any functionality offered by those networks. We are not a financial entity, a bank, or an investment advisor. The Platform acts solely as an interface for you to manage your digital assets autonomously. We do not control, manage, or store your assets and are not responsible for the operation of the Compatible Blockchains.
2. Non-custodial character
Your keys, your crypto. Latin Link is a non-custodial wallet, meaning you have exclusive control over your private keys and digital assets across all Compatible Blockchains. You are solely responsible for securing, backing up, and managing your private keys. Latin Link does not have access to your keys or funds and cannot recover assets if access is lost.
3. Eligibility and legal compliance
- You must be at least 18 years old or of legal age in your jurisdiction, and have the legal capacity to accept these Terms.
- Availability: Latin Link is not available in jurisdictions where cryptocurrencies or the Compatible Blockchains are prohibited. You are responsible for verifying and complying with local laws before using the Platform. Use in countries with legal restrictions is at your own risk.
- You declare that you have confirmed the legality of your participation in your country of residence.
4. Use of the platform
- Functionality: The Platform allows interaction with Compatible Blockchains to participate in activities such as delegation, staking, or rewards offered by those networks (e.g., Flare Drops on the Flare network). Latin Link does not control the Compatible Blockchains or their rewards, which depend on third parties and on the dynamics of each blockchain.
- Restrictions: You may not use the Platform for illegal, fraudulent, or prohibited activities, including money laundering, financing illegal activities, or any use that violates local laws.
- Account: Some features may require registration with accurate information. You are responsible for keeping your account and password confidential and for all activities under your account.
5. No financial advice
Latin Link does not provide financial, legal, tax, or investment advice. Decisions related to using the Platform or the Compatible Blockchains (e.g., delegation, staking) are your sole responsibility. Cryptocurrencies and blockchains involve significant risks; we recommend that you do your own research before participating.
6. Risks
Using cryptocurrencies and Compatible Blockchains involves risks, including but not limited to:
- Volatility: Token values can fluctuate drastically.
- Loss of access: Losing private keys can result in total loss of assets, with no possibility of recovery by Latin Link.
- Technical failures: Compatible Blockchains or the Platform may experience errors, interruptions, cyberattacks, or network failures.
- Regulatory changes: Local laws may change, affecting the use of cryptocurrencies or the Platform. Latin Link does not guarantee rewards, stability, or specific results when using the Platform or Compatible Blockchains.
7. Intellectual property
All elements of the Platform (logo, design, content, code, interface) are the property of Latin Link or its licensors. You may not copy, modify, distribute, or reproduce these elements without prior written authorization.
8. Operational costs
Latin Link may apply operational charges to maintain and operate the Platform, which will be disclosed when using certain features, if applicable. You are responsible for any network fees associated with the Compatible Blockchains (e.g., gas fees). Operational charges do not constitute a promise of financial performance nor guarantee specific results.
9. Taxes
You are solely responsible for declaring and paying any taxes arising from rewards, transactions, or activities carried out through the Platform, in accordance with the laws of your jurisdiction. We recommend consulting a tax advisor.
10. Limitation of liability
- No warranties: The Platform is provided "as is," without express or implied warranties of merchantability, fitness for a particular purpose, or continuous availability. We do not guarantee the accuracy, reliability, or availability of the Compatible Blockchains or their rewards.
- No liability for losses: Latin Link is not responsible for losses arising from use of the Platform, failures in the Compatible Blockchains, loss of private keys, user errors, or changes in legislation.
- Third parties: We are not responsible for the performance of the Compatible Blockchains or third-party services (e.g., FTSO data providers on Flare or other protocols).
11. Changes to the terms
We reserve the right to modify these Terms at any time. Changes will be notified through the Platform (e.g., notification in the app or website) with at least 7 days' notice. Continued use of the Platform implies acceptance of the new Terms.
12. Privacy
We do not collect sensitive personal data beyond what is strictly necessary to operate the Platform. See our Privacy Policy for details on how we handle your data, in compliance with applicable laws in the countries where we operate (e.g., Mexico's Federal Law on Protection of Personal Data, Brazil's LGPD).
13. Suspension or termination
We may suspend or terminate your access to the Platform at any time if you violate these Terms, if required by law, or for operational reasons, without prior notice or liability.
14. Governing law and dispute resolution
These Terms are governed by the laws of Panama, without prejudice to local laws you must comply with in your jurisdiction. Any dispute related to the Platform will be resolved exclusively in the courts of Panama City, Panama, unless local law requires otherwise. Latin Link is not obligated to participate in legal proceedings in the user's jurisdiction.
